LEGAL PREMISE

This document constitutes the official and legally binding version of the Rules. While translations in other languages may be provided for convenience, in the event of any discrepancy, interpretation conflict, or dispute, the provisions set forth in this English version shall prevail and be final. By participating in the Sweepstake, the entrant fully accepts the provisions of these Rules and acknowledges the jurisdiction of the Republic of Moldova.

1. PROMOTER, NATURE AND TERRITORIAL SCOPE

1.1. The Promoter

1.2. Nature of the Initiative

The Competition is a prize draw event based on random extraction, aimed at promoting digital campaigns and commercial initiatives of the Organizer and, where provided, authorized partners. The Competition does not constitute gambling, betting, or an activity subject to specific local government authorization, operating under the jurisdiction of the host country.

1.3. Territorial Scope (Global Access)

The Competition is conducted on a global basis and is accessible via the internet internationally. The Organizer does not limit geographic access but does not engage in specific active solicitation in individual jurisdictions where such competitions are prohibited. Participation by residents of the European Union (EU) or European Economic Area (EEA) occurs upon the user's spontaneous initiative (Unsolicited Act).

1.4. Extra-EU Transfer and Guarantees

Since the Organizer is established in a Third Country (Moldova), the processing of EU citizens' data is legitimized and regulated through:

• Subscription to Standard Contractual Clauses (SCC 2021, Module 1);
• Execution of a Transfer Impact Assessment (TIA);
• Adoption of supplementary technical measures (AES encryption, access controls, immutable logging) in accordance with Arts. 44–46 GDPR.

2. OFFICIAL LANGUAGE AND UNDERSTANDING

2.1. Official Language

The official language of the Competition is English. Any versions provided in other languages are exclusively courtesy translations and are non-binding.

2.2. Understanding Clause

By accepting the Rules via the specific checkbox in the registration form, the participant expressly declares:

• To have understood the conditions of participation;
• To accept the prevalence of the English version in case of disputes;
• To acknowledge the international nature of the initiative and the promoter.

3. ELIGIBILITY REQUIREMENTS

3.1. Subjective Requirements

Participation is reserved exclusively for natural persons who:

• Are 18 years of age or older at the time of registration;
• Provide truthful and complete personal data;
• Verify ownership of their phone number via OTP SMS procedure;
• Fully accept the Official Rules and Privacy Policy.

3.2. Exclusions

The following are strictly excluded from participation:

• Employees, directors, and continuous collaborators of the Organizer;
• Cohabiting family members of the subjects indicated above;
• Users employing scripts, bots, or automated systems to manipulate the outcome.

3.3. Anti-Fraud System

The Organizer reserves the right to:

• Block phone numbers detected as "virtual", temporary, or duplicates;
• Prevent multiple registrations traceable to the same real user;
• Request further documentary verification in case of winning or anomalies (e.g., ID).

4. ENTRY METHOD

4.1. Procedure

To participate validly, the user must:

1. Complete the online digital form in all its mandatory parts;
2. Validate the mobile number by entering the OTP code received via SMS;
3. Check the acceptance boxes for the Privacy Policy and Official Rules;
4. (Optional) Grant or deny consents for marketing purposes.

4.2. Marketing Consent – Not Mandatory

Participation in the competition is independent of marketing consents. The participant is free to:

• Deny consent to receive commercial communications from the Organizer;
• Deny consent for data transfer to third-party partners.

Failure to provide such consents does not invalidate participation nor reduce the chances of winning.

4.3. Uniqueness

Each participant may enter only once. The system technically prevents multiple registrations associated with the same verified phone number.

5. DURATION, DRAW AND WINNERS

5.1. Duration

The Competition is active from 01/01/2026 to 31/12/2026. Automatic annual renewal is provided unless otherwise communicated on the official website.

5.2. Draw Mechanism

Prizes are assigned using certified Random Number Generator (RNG) software, designed to guarantee:

• Absolute randomness of the draw;
• Non-manipulability of the algorithm by the Organizer or third parties;
• Traceability of operations through immutable system logs.

5.3. Communication and Confirmation

Winners will be contacted via SMS and e-mail at the provided details within 48 hours of the draw. The winner has 72 hours from notification to confirm acceptance and provide a shipping address. Failure to respond within this timeframe will result in the prize being deemed refused and potentially reassigned to a reserve.

6. PRIZES AND LOGISTICS

6.1. Prize Pool

The prizes offered consist of goods of a technological/digital nature:

• Apple iPhone (Pro model or higher, Global version);
• E-bike 250W (compliant with EU standard EN 15194);
• Apple Watch (GPS version);
• Amazon Europe Gift Card or Prepaid Card (value € 200.00).

6.2. Availability

The Organizer undertakes to deliver the indicated prize. However, in case of unavailability (e.g., end of production), it reserves the right to substitute it with a good or service of equal or higher commercial value.

6.3. Shipping (Customs)

To facilitate winners resident in the EU, physical prizes will be shipped, where possible, via logistics centers located within the European customs area (e.g., Amazon Fulfillment EU), with the Organizer bearing standard shipping costs.

6.4. Brand Disclaimer

Apple Inc., Amazon Inc., and other mentioned brands are owners of their respective trademarks. These companies are not sponsors, partners, nor in any way involved in the organization or administration of this Competition.

7. PRIVACY AND DATA PROCESSING (GDPR)

7.1. Data Controller

The Data Controller is Î.C.S. BESTEAST S.R.L. (Contact details in Art. 1.1).

7.2. Purposes and Legal Basis

Data is processed for:

1. Competition Management: (Legal basis: Contractual necessity);
2. Direct Marketing: (Legal basis: Explicit consent);
3. Transfer to Third Parties: (Legal basis: Separate explicit consent);
4. Security and Anti-fraud: (Legal basis: Legitimate interest).

7.3. Transfer Guarantees

Data transfer to Moldova is protected by adequate measures under Chapter V of the GDPR, including:

• Signing of Standard Contractual Clauses (SCC);
• Adoption of end-to-end encryption protocols for data in transit and at rest.

7.4. Rights of the Data Subject

Users may exercise their rights under Arts. 15-22 GDPR (Access, Rectification, Erasure/Right to be Forgotten, Restriction, Portability) at any time by writing to the DPO at: privacy@dataquanto.com.

8. LIMITATION OF LIABILITY

The Organizer shall not be held liable for:

• Malfunctions of the internet or telephone network preventing participation;
• Spam filters blocking winning notifications;
• Incorrect or untruthful data provided by the user making prize delivery impossible.

9. APPLICABLE LAW AND JURISDICTION

9.1. Applicable Law

This Regulation and the entire conduct of the Competition are governed exclusively by the laws of the Republic of Moldova.

9.2. Competent Court

For any dispute arising from the Competition, the parties acknowledge the exclusive jurisdiction of the Courts of Chișinău (Moldova). Mandatory rights granted to consumers by the imperative norms of their country of residence remain unaffected, where applicable despite the choice of foreign law.
